FILM AND VIDEO COMMERCIAL USAGE AGREEMENT

1. The material (Film/Videotape) subject to this agreement is provided to the Grantee on a nonexclusive, one-time use basis for the production (identified in #2 below) which may be shown multiple times in perpetuity.
2. The Grantor agrees to provide the Grantor's material for the following one-time production: ______________________________________________________ to be shown in the following market (s) [circle all that apply]: Local/State; Nation/World; Non-Broadcast; Videocassette, CD, or other media.
3. The Grantee agrees to provide the Grantor compensation based on the fee structure for film and video materials (Film and Video Commercial Use Fee Schedule).
4. The Grantee assumes all liability and responsibility for any further authorizations, consents, clearances, or copyrights required to use the Grantor's material.
5. The Grantee agrees to indemnify the Grantor, its successors or assigns, and hold harmless from and against, any loss, liability, or expense, (including reasonable legal fees) arising from the use of the material by the Grantee or their successors or assigns.
6. The Grantee agrees to pay laboratory and transportation costs involved in the making the material available.
7. 7. The Grantee agrees to include the screen credit: Archives and Special Collections Department, Consortium Library, University of Alaska Anchorage.
8. The Grantee agrees to provide the Grantor with a statement indicating the amount of film or video (in seconds) acquired from the Grantor that was used in the final production product. This statement is to be accompanied by a payment to cover any additional footage beyond the initial minimum payment (30 seconds).
9. All fees are nonrefundable.
10. The Grantee agrees to provide the Grantor with a 1/2 inch VHS copy plus a suitable master (3/4 inch U-Matic, Mini-DV, or other master) of the completed production.
